AIBE Result Announcement Scheduled for Apr 2023: BCI Extends SBC Validity
The Bar Council of India has decided to extend the validity of bar council enrollment, and period from October 2021 to April 2023 to be exempted for all candidates.
All candidates who will be taking the AIBE 17 have been given a resolution by the General Council of the Bar Council of India regarding the validity of their state bar council enrollment. All candidates who were scheduled to appear for AIBE 17 and were concerned about the end of legal practice have now been exempted with an extension in the validity of their enrollment. The enrollment period for each of these candidates will range from October 2021 to April 2023.
The resolution shared by the BCI stated that "This is to bring it to your kind knowledge that General Council of the Bar Council of India has passed a resolution with regard to exemption of time period with regard to passing AIBE after Enrolment as an Advocate.
The Resolution dated Dec 30, 2022, is given below:
Many Advocates have been requesting help from the Bar Council of India since they have suffered greatly as a result of the pandemic. Many of them were not even able to provide for their families most basic needs. Even if they could make arrangements for food, they had trouble doing the same for medicine and medical treatment.
In the midst of the pandemic, many Advocates lost loved ones. Despite the best efforts of the Bar Council of India, State Bar Councils, several Bar Associations, and many benevolent Advocates, the closing of courts caused a lot of harm to the legal community as a whole.
The majority of the legal community was subsequently denied their right to a livelihood due to the warehousing of online proceedings by a certain sector of attorneys, as well as the pandemic's effects on the paying capacity of clients and the number of lawsuits.
The statement "The Bar Council of India had earlier vide a resolution dated Jul 29, 2020, had exempted the period from Mar 24 to 31, 2021 from being counted as a necessary time period from the point of view of considering it within the requisite time period of two years from the date of enrolment, to clear the AIBE in order to further highlight the fact that previously too, a one-year extension was given to all candidates who enrolled with state bar council.
The period to be exempted for AIBE 2022 is, "By way of this instant resolution, dated Dec 30, 2022, it is hereby resolved that the period from the date of the last All India Bar exam held on Oct 31, 2021 till-April, 2023, by which time, the result of the next AIBE is likely to be declared, is hereby exempted from being counted as a necessary time period from the point of view of considering it within the requisite time period of two years from the date of enrolment as an Advocate to pass AIBE.
It is hereby resolved that this period shall remain exempt and shall not be counted when calculating the two year period from the date of enrolment for the purposes of counting the time period for clearing/passing the AIBE. As a result, the duration of the mentioned dates is to be excluded when calculating two years for enrolled candidates.
